Novelis Announces Court Dismissal Of Coca-Cola Lawsuit

ATLANTA, July 12 /PRNewswire/ -- Novelis Inc., the world's leading producer of aluminum rolled products, announced today that the Superior Court of Fulton County, Georgia, has dismissed a lawsuit filed against the company by Coca-Cola Bottler's Sales and Services Company LLC (CCBSS).  

"While we expected to win, we are pleased with the Court's ruling," said Phil Martens, President and COO of Novelis.  "Now that the suit is formally dismissed, we will continue to keep focused on what we do best -- providing high-quality aluminum rolled products to our customers, including Coca-Cola's bottlers."

The lawsuit was filed against Novelis Corporation, the company's U.S. subsidiary, in Georgia state court on February 15, 2007.  CCBSS alleged in its complaint that Novelis breached the contract between the parties and sought monetary damages in an amount to be determined at trial.  In an opinion filed on Thursday, July 8, 2010, the Court granted Novelis' motion for summary judgment, dismissing CCBSS's claims.  CCBSS has not indicated whether it plans to appeal.
